First-draft policy
This document is a working first draft prepared so PIKL can run an early-access programme with reasonable transparency. A solicitor will review and finalise the binding version. If you spot anything that looks wrong, contact us and we will get the right person to look at it.
01. Agreement to these terms
These terms of use are an agreement between you and DRFT Solutions Ltd, a company registered in England and Wales (together, “PIKL”, “we”, “us”). They apply when you visit https://www.pikl.app, sign in to a player account, or use any of the apps and services we publish under the PIKL brand (the “Service”).
By creating an account, signing in, or using the Service, you accept these terms. If you do not accept them, please do not use the Service.
We may update these terms from time to time. When we make a material change, we will update the “Last updated” date at the top of this page and, where the change affects your account, give you reasonable notice by email or through the Service before it takes effect.
Your statutory rights are not affected
02. What PIKL is
PIKL is a pickleball platform. Players use it to find courts, join clubs and groups, organise games, book sessions, and keep track of their pickleball week. Clubs, groups, and venues use the same platform with extra tools to publish sessions, manage members, and take payments where they have a paid plan.
We may add, change, or retire features at any time. Where a change materially affects how you use the Service, we will give you reasonable notice before it happens.
03. Eligibility and your account
You can use PIKL if you are at least 13 years old. If you are under 18, you confirm that a parent or guardian has read these terms and agreed to your use of the Service.
To open an account, you agree to:
- Provide accurate, complete, and up-to-date information.
- Keep your sign-in details (phone number, password, or social login) confidential.
- Be responsible for activity on your account, including content you post.
- Not impersonate another person or pretend to act on their behalf without authority.
- Tell us as soon as you suspect unauthorised use of your account.
We may refuse, suspend, or close an account where the information is false or out of date, where the account breaches these terms, or where we are required to do so by law.
04. Acceptable use
You agree not to use PIKL to:
- Break the law, infringe someone else's rights, or facilitate either.
- Harass, threaten, defame, or impersonate another person.
- Post safeguarding-relevant or sexually-explicit content involving children.
- Upload viruses, malware, or other code that interferes with how the Service runs.
- Reverse engineer, scrape, or otherwise extract data from the Service except as the law permits or as we have agreed in writing.
- Resell, sublicense, or commercialise PIKL data without our permission.
- Use automated tools, bots, or scripts to interact with the Service in ways that are not reasonably equivalent to a normal user, including bulk account creation.
- Try to bypass any security, rate-limit, or access control we put in place.
- Misrepresent club, group, or venue information in ways that could mislead other players (for example, posting fake court details or false fees).
We can remove content, restrict features, or close accounts that breach this section, with or without notice depending on the severity. Where the law requires it, we will report serious abuse to the relevant authority.
05. Content you post
You keep your rights
You own the content you post on PIKL — profile photos, club banners, group avatars, court reviews, posts, comments, messages, and so on (“User Content”). Posting content on PIKL does not transfer ownership to us.
What we need to display it
By posting User Content, you give us a worldwide, non-exclusive, royalty-free licence to host, store, copy, format, and display that content as part of running the Service. The licence covers what we need to deliver PIKL to you and to other players who are entitled to see it (for example, club banners shown on a club's public profile). We will not sell your User Content to third parties.
Your responsibilities for what you post
You confirm that you have the right to post each piece of User Content, that it does not infringe anyone's rights, and that it complies with these terms and applicable law.
Removal
You can delete your User Content at any time, except where we are required to keep a record (for example, for safety, audit, or legal reasons). When you delete content, copies may persist temporarily in backups before they are overwritten in the normal course of operations.
06. Clubs, groups, and organisers
If you run a club, group, venue, or coach profile on PIKL, you are responsible for the content you publish, the sessions you list, and how you treat the players who use them.
In particular you agree to:
- Publish accurate session, court, fee, and cancellation information.
- Honour your published joining, refund, and cancellation rules unless players agree otherwise in writing.
- Comply with any safeguarding, child-protection, and licensing requirements that apply to your activity.
- Treat member-only information you receive through PIKL as confidential to your club or group.
- Comply with all applicable data-protection laws when you handle player data, including UK GDPR. Where you collect data outside PIKL (for example, on a paper signup sheet) you are the controller for that data.
PIKL is a platform — we do not run your sessions, take part in your coaching, or stand behind your published rules. Disputes between players and organisers are between those parties, although we may step in where these terms have been broken.
07. Bookings, payments, and refunds
Free for players
The PIKL Player tier is free. We do not charge players to find courts, join groups, RSVP to sessions, or use the basic features.
Paid features
Some features for clubs, groups, and other organisers require a paid plan. The price, billing period, and what is included will be shown before you subscribe. Where prices change, we will give you notice before the next billing date.
Bookings and member payments
Where a club or group takes payment from a player through PIKL — for a session, league entry, or membership — payments are processed by Stripe. By making or receiving payment through PIKL you agree to Stripe's terms (and, where you are receiving payment as an organiser, the Stripe Connected Account Agreement). PIKL does not hold member funds — they flow from the player to the organiser through Stripe.
Refunds and cancellations
Refunds for sessions or memberships are governed by the published rules of the club or group that runs them. Where you believe an organiser has not honoured their published refund rules, contact them in the first instance. If you cannot resolve the issue, contact us at support@pikl.app and we will help where we can.
Your statutory cancellation right (paid plans)
If you take out a paid PIKL plan as a consumer in the UK, you have 14 days to cancel without giving a reason under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, unless you have asked us to start the service immediately and have used it during that period.
08. Third-party services
PIKL connects to a number of third-party services to make the platform work — payment processing, mapping, search, messaging, email delivery, and so on. We list the main ones in our privacy notice.
Where you click a link to a third-party site (for example, a venue's own website or a club's social media), that site is governed by its own terms and privacy policy. We are not responsible for content, services, or practices on third-party sites.
09. Our content and trade marks
The PIKL name, logo, brand assets, source code, designs, and content we publish (other than User Content) are owned by DRFT Solutions Ltd or used under licence. Nothing in these terms transfers any of those rights to you.
You may use the Service for personal, non-commercial use, and clubs and groups on a paid plan may use it for the activities that plan covers. You may not copy, scrape, republish, or otherwise exploit PIKL content without our written permission.
10. Copyright complaints
If you believe content on PIKL infringes a copyright or trade mark you own or control, send a notice to legal@pikl.app with:
- A description of the work you say is infringed.
- A link to the PIKL page where the allegedly infringing content appears.
- Your contact details.
- A statement that you believe in good faith the use is unauthorised.
- A statement that the information you have given is accurate.
- Your physical or electronic signature.
We will review legitimate notices and act on them where appropriate, which may include removing the content, restricting access, or closing the account that posted it. We may share your notice with the person who posted the content.
11. Suspension and termination
You can close your account at any time from your settings or by contacting us. We can suspend or close your account where you have breached these terms, where we are required to do so by law, or where leaving an account active would put the Service or other users at risk.
Where we suspend or close an account because of a serious breach (for example, harassment of other users), we may do so without advance notice. Otherwise we will give you reasonable notice and a chance to put things right.
When an account closes, you lose access to the features and data tied to it. We retain some account information for the periods set out in our privacy notice, including for legal, audit, or fraud-prevention reasons.
12. Disclaimer
PIKL is provided on an “as is” and “as available” basis. We do not guarantee that the Service will always be available, free from errors, secure against every threat, or meet every expectation you have for it.
Where information about a club, group, court, session, or player comes from another organiser or another player, we cannot guarantee its accuracy. Always check directly with the relevant organiser or venue before travelling, paying, or making other commitments.
13. Our liability to you
Nothing in these terms limits our liability for: death or personal injury caused by our negligence; fraud or fraudulent misrepresentation; any other liability that cannot be limited or excluded under English law.
Subject to the paragraph above, our total liability to you in connection with the Service in any 12-month period is limited to the greater of: the amount you paid us in that period, or £100.
We are not liable for losses that were not reasonably foreseeable to both of us when you started using the Service, for losses that arise from you breaching these terms, or for indirect or consequential losses such as loss of profit, loss of business opportunity, or loss of goodwill. This does not affect your statutory rights as a consumer.
14. Indemnity
If you use PIKL in breach of these terms or applicable law and that causes us loss or a third-party claim, you agree to cover the reasonable costs we incur in dealing with it, including legal costs. This does not apply to consumers acting outside their trade, business, craft, or profession to the extent UK consumer law excludes it.
15. Changes to the service or these terms
We can change the Service or these terms where we have a good reason to (for example, to comply with the law, to reflect a change in how the platform works, or to improve security). For material changes that affect your use, we will give you reasonable notice before they take effect.
If you do not agree to a change, you can close your account before the change takes effect.
16. Governing law and jurisdiction
These terms and any dispute connected with them are governed by the law of England and Wales. The courts of England and Wales have non-exclusive jurisdiction over any dispute. If you are a consumer resident in Scotland or Northern Ireland, you may bring proceedings in the courts of the part of the UK where you live.
17. How to raise a complaint
If something has gone wrong with PIKL, please email support@pikl.app first. We will reply within a reasonable time and try to resolve the issue. If we cannot resolve it together, you may have access to alternative dispute resolution (for example, the Online Dispute Resolution platform run by the European Commission) or to the small claims court.
18. Other points
| Topic | What it means |
|---|---|
| Whole agreement | These terms (with our privacy and cookie notices, and any specific terms shown when you take a paid plan) are the whole agreement between us. |
| No waiver | If we choose not to enforce a clause, that does not mean we have given it up. |
| Severability | If a court finds a clause unenforceable, the rest of the terms still apply. |
| Assignment | You may not transfer your account or these terms to anyone else without our written consent. We may transfer them to a group company or in connection with a sale of the business, in which case we will let you know. |
| Notices | Where these terms require us to give notice, we may do so by email to your account address or by an in-product message. |
| Force majeure | Neither of us is responsible for failure to perform these terms because of an event outside our reasonable control (for example, a major outage at a hosting provider). |
